First Day of Summer Instagram Giveaway

WILL & CO FIRST DAY OF SUMMER COMPETITION TERMS AND CONDITIONS

By participating in the promotion, each participant fully and unconditionally agrees and acknowledges that these terms and conditions are binding.

1. Promoter: Will & Co Coffee – Level 1, Shop 7, 184 Campbell Parade, Bondi Beach NSW 2026 – (02) 9748 0299 
   
   
2. Promotional Period: The First Day of Summer competition will run from 6.00pm AEDT on Sunday, 1 December 2024 until 6.00pm AEDT on Tuesday, 10th December 2024.
   
   
3. Eligible Entrants: This giveaway is open to Australian residents only who are 18 years and over.
   
   Directors, management, employees, officers, contractors, and their immediate families of the Promoter or of the agencies or companies associated with this promotion are ineligible to enter. "Immediate family members" means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
   
   
4. How to Enter: To enter the First Day of Summer competition, entrants must, during the Promotional period;
   
   
   • Follow all of the following participating brand Instagram accounts: @willandcocoffee, @nimbleactivewear, @bondiwash and @curlylewisbrewingco;
   • Like the Will & Co post promoting the giveaway on the Will & Co Instagram account; and
   • Comment on the Will & Co post promoting the giveaway by tagging a friend who they would like to share the prize with. Comment must mention verbiage around ‘how they will be enjoying summer’.
   • Additional entries permitted for reposting giveaway post on Instagram stories.
   
   
5. Entries Permitted: An entrant can enter multiple times during the Promotional Period.
   
   The Promoter reserves the right to verify the validity of all Entries and reserves the right to disqualify any Entrant or the Entry that is not in accordance with or in compliance with these Terms and Conditions. Winning Entry will be checked for compliance with the entry conditions.
   
   
6. Prize: The Promoter will draw one winner from the pool of valid entries. The first valid entry drawn will be the winner. The winner may select one (1) friend and each will be awarded the following prizes:  
   
   
   • 1 x $125 Will & Co HQ Tasting Bar Bondi Beach gift voucher (if the winner and friend are located within Greater Sydney) OR ‘A Summer’s Worth of Coffee Prize’ (if the winner and friend are located outside of Greater Sydney – see below for details);
   • 1 x $125 Nimble Activewear gift voucher, redeemable in store or online;
   • 1 x $125 Bondi Wash gift voucher, redeemable in store or online; and
   • 1 x $125 Curly Lewis gift voucher, redeemable in store (if the winner and friend are located within Greater Sydney) OR online (if the winner and friend are located outside of Greater Sydney).  

   
   The ‘A Summer’s Worth of Coffee Prize’ includes either:

   • 1 x 1 kilogram of Will & Co coffee beans (excluding any single origin coffee beans) delivered per month for 3 months (max 3kg); or
   • 4 x packs of 250 grams of Will & Co ground coffee delivered per month for 3 months (max 3kg); or
   • 6 x boxes of Will & Co Nespresso* Compatible Pods (10 pods per box) delivered per month for 3 months (max 18 boxes).

    
   The prize bundle has a total value of $1,000 AUD. Prizes cannot be transferred, exchanged  or redeemable for cash.

7. Draw Date: This is a game of chance where entries will be chosen completely at random. The prize draw will be held 10:00am Thursday, 12 December 2024 at Will & Co, Shop 7 Level 1, 184 Campbell Parade, Bondi Beach NSW 2026.
   
   
8. Prize Redemption: The winner will be contacted by the Promoter via the @willandcocoffee Instagram account and provided necessary contact information. Gift vouchers will be sent via email.
   
   
9. Winner Selection and Notification:
   
   
   • The winner will be selected randomly from all eligible entries received during the entry period.
   • The winner will be contacted directly from the @willandcocoffee account within 3 business days of the end of the entry period.
   • If the winner does not respond within 7 days of the notification, a new winner will be selected at random by promoter
   
   
10. General Conditions

• If this competition is not viable or able to be conducted as originally anticipated due to any reason beyond the Promoter’s reasonable control, the Promoter may in its absolute discretion alter, suspend, or cancel the competition as deemed reasonably appropriate. In the unlikely event of this occurring, a notice will be posted on the Promoter’s website.
• Entrants acknowledge that any personal information collected will be used solely for the purpose of the giveaway and will not be shared with third parties without consent.
• This promotion is in no way sponsored, endorsed, administered by or associated with Instagram. By entering, Entrants release Instagram of responsibility, and agree to Instagram’s terms of use.
• The Promoter reserves the right to vary these Terms and Conditions or to modify, suspend, terminate or reschedule the Promotion.
• The Promoter may request that the Winner and their selected friend to provide proof of identity, proof of age or proof of residency to the Promoter’s reasonable satisfaction before awarding the prize. If the winner and their selected friend do not provide proof of identity, proof of age or proof of residency to the Promoter’s reasonable satisfaction  within 7 days after being selected as the winner, then they may be deemed to have forfeited their entitlement to their prize. In those circumstances the Promoter may conduct a redraw.
• The Promoter is not liable for any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained during the course of accepting or using the prize, except for any liability which cannot be excluded by law.
• On accepting the Prize, the winner agrees the Promoter will publish the winner’s first name, surname initial and postcode on the Promoter’s website. It is a condition of entry that the Promoter has the right to publicise, broadcast and communicate to the public the names, characters, likenesses, or voices of entrants for any promotion or matter incidental to the competition. All Entrants accept and permit the use of this information on any medium. Entrants’ information will be collected, held, used and disclosed in accordance with the Promoter’s Privacy Policy available here.
• Entrants agree that by entering this competition and providing their email address to the Promoter, they consent to receiving marketing communications from the Promoter. Entrants’ can unsubscribe from receiving marketing communication by contacting the Promoter on (02) 9748 0299 or by following the unsubscribe instructions provided in the marketing communication.
• The Promoter reserves the right to vary these Terms and Conditions or to modify, suspend, terminate or reschedule the Promotion, subject to regulatory approval.
• Except for any liability that cannot be excluded by law, the Promoter will not be responsible for any loss, injury, cost, expense, harm or damage whatsoever that may arise directly or indirectly as a result of this competition, including without limitation, where it arises from:
  • theft or fraud;
  • the unauthorised access to or alteration of entries;
  • an error, interruption, misdirection, deletion, defect, or delay in the transmission of information related to this competition which is beyond the reasonable control
  • any third-party interference.
  • any technical malfunctions or problems with computer equipment or software
  • the redemption of gift vouchers, and
  • participation in this competition generally.
